A Gerência de Combate ao Crime Organizado (GCCO) deflagrou, nesta quarta-feira (18.12), a Operação Nota Fria contra investigados por cometer o crime da duplicata simulada em um conglomerado agropecuário com unidade no município de Sapezal.

As ordens de busca e apreensão foram cumpridas em endereços domiciliares e em uma empresa nas cidades de Sapezal e Rondonópolis. Foram apreendidos notebbok, documentos e R$ 13 mil.

De acordo com o inquérito conduzido pelo delegado Mário Santiago, um dos investigados, que era funcionário da fazenda e líder dos setores de lubrificação e abastecimento, R.A.S, de 42 anos, tinha sob sua gestão a manutenção de pneus dos veículos da propriedade, serviço para o qual tinha autonomia de decisão.

Em janeiro do ano ado, o investigado cadastrou junto à agropecuária uma prestadora dos serviços de borracharia e recapagens de pneus. Essa empresa emitiu 250 notas fiscais, que totalizaram R$ 3 milhões, sem que tenha realizado efetivamente os serviços para a fazenda.

A agropecuária fez uma apuração interna e constatou que não houve registros de entrada e saída de pneus a serem recapados naquele período.


Notas frias 

A GCCO apurou que a prestadora de serviços tem como endereço a cidade de Rondonópolis e foi constituída há quatro anos, com capital social de R$ 5 mil. Contudo, a atividade principal, conforme o cadastro de pessoa jurídica, é consultoria em gestão empresarial. Já o serviço de borracharia é uma atividade secundária.

A investigação apontou que os valores nas notas fiscais emitidas pela prestadora de serviços, além de não condizer com o que foi prestado, são incompatíveis com a demanda gerada pela fazenda de Sapezal.

Somente em 2023, a agropecuária pagou o valor de R$ 1.226.674,22 em notas fiscais de serviços que não foram realizados. Neste ano, o valor foi ainda maior, chegando a R$ 1.636.327,32.

Uma comparação entre os serviços pagos na fazenda de Sapezal e em outra propriedade do mesmo grupo, que tem o dobro de veículos, mostrou que a agropecuária pagou quase dez vezes mais em Sapezal por recapagem.

Após autorizações, uma inspeção no computador corporativo utilizado pelo investigado identificou  uma proposta comercial relativa à empresa prestadora de serviço em que constavam 181 revisões, sugerindo modificações no mesmo documento antes de sua conversão para o arquivo em PDF. Na conta corporativa de e-mail do funcionário encarregado do setor de pneus da agropecuária não havia nenhum
orçamento recebido da empresa de serviços sediada em Rondonópolis, porém, havia diversas notas fiscais, em nome dessa empresa, para os setores responsáveis por lançamentos e pagamentos.

“Fato interessante apurado na investigação é que a prestadora de serviços supostamente de recapagem tem como endereço a cidade de Rondonópolis e a fazenda sediada em Sapezal, a cerca de 750 km de distância. Outro fato que chama atenção é a emissão sequencial das notas fiscais em desfavor da empresa vítima, sugerindo que a fazenda seria o único cliente da empresa prestadora de serviços”, observou o delegado Mário Santiago.

A operação contou com apoio da Delegacia de Sapezal e 1a Delegacia de Rondonópolis.
